Introduction:
1. Scope of Service
Foreclosure GA 360 provides title search reports and related services for foreclosure properties in Georgia.
Reports are intended for informational purposes only and are not a substitute for legal, financial, or professional advice.
Title search reports include details about title history, liens, and other property-related issues based on data from trusted sources such as GSCCCA.
2. Accuracy and Limitations
While we strive for accuracy, Foreclosure GA 360 does not guarantee error-free reports.
Clients are encouraged to perform independent due diligence before making financial decisions.
Reports may not include unrecorded liens, off-record issues, or unfiled claims that could affect the property title.
Third-Party Data Disclaimer: Foreclosure GA 360 relies on public and third-party data sources for report compilation. We are not liable for inaccuracies or omissions in third-party data that may impact report content.
3. Liability Disclaimer
Foreclosure GA 360 is not liable for any financial decisions, investments, or outcomes based on reliance on our reports or opinions.
All interpretations or opinions provided by Foreclosure GA 360 are non-binding and should not be solely relied upon for investment decisions.
4. Claims and Error Resolution
If an error is identified in a report, FCGA 360 LLC, powered by Prowess Title Abstracts, LLC, reserves the right to correct it promptly. All claims must be filed directly through Prowess Title Abstracts, LLC. FCGA 360 LLC is not liable for any financial losses or decisions made prior to the correction.
Clients must notify Prowess Title Abstracts, LLC of any errors within 10 business days of report delivery to qualify for corrections or insurance claims.
Only the Winning Bidder May Submit a Claim: The right to file a claim is exclusively granted to the winning bidder who relied on FCGA 360 LLC's report, provided by Prowess Title Abstracts, LLC, to secure the property at auction. Non-winning bidders are not eligible to file claims, as they incur no financial loss based on the report.
For any claim-related inquiries, clients must contact Prowess Title Abstracts, LLC directly.
5. Subscription Terms
Subscriptions are available on a monthly or 6-month basis and include access to 100-150 title reports per month.
Subscriptions are non-refundable and auto-renew unless canceled before the next billing cycle.
Subscriptions activated mid-month will begin with the next report cycle. Partial-month refunds or prorated access are not provided.
Cancellation requests must be submitted via text or email before the renewal date to avoid further charges.
6. Single Report Purchases
Single reports are available for $45 (insured) or $27 (uninsured).
Single report purchases do not include subscription benefits or recurring access.
7. Access and Use of Reports
Reports are exclusive to active subscribers and may not be shared, redistributed, or resold to third parties.
Unauthorized distribution of reports may result in immediate termination of access and potential legal action.
Client Responsibility: Clients are responsible for maintaining the confidentiality of their login credentials. Foreclosure GA 360 is not liable for unauthorized access resulting from client negligence.
8. Refund Policy
Refunds are not provided for subscription fees, single report purchases, or errors corrected in a timely manner.
Clients requesting refunds must submit written requests within 30 days of purchase for review.
9. Privacy Policy
Client data is protected in accordance with our Privacy Policy.
Foreclosure GA 360 will not sell or share personal information with third parties without explicit consent.
10. Misuse of Services
Reports provided by Foreclosure GA 360 are for legitimate investment purposes only.
Misuse of report data for fraudulent or illegal activities is strictly prohibited and may result in legal action.
11. Force Majeure Clause
Foreclosure GA 360 shall not be held liable for delays or service failures caused by events beyond our control, including but not limited to natural disasters, power outages, cyberattacks, government restrictions, or labor strikes.
12. Intellectual Property
All reports, website content, and materials provided by Foreclosure GA 360 are the intellectual property of the company and may not be reproduced, distributed, or used without written consent.
13. Dispute Resolution
In the event of a dispute regarding services or report accuracy, clients agree to first engage in informal resolution by contacting Foreclosure GA 360.
If unresolved, disputes may proceed to mediation under Georgia jurisdiction.
14. Governing Law
These terms are governed by the laws of the state of Georgia.
Any disputes arising from the use of our services will be resolved in accordance with Georgia law.
15. Amendments to Terms
Foreclosure GA 360 reserves the right to update or amend these terms at any time.
Clients will be notified of significant changes through email or website updates.
